Who we are
This site is run by BrightwatersAI Pty Ltd (ABN 75 692 776 195, ACN 692 776 195), trading as Brightwaters AI, based in Sydney, New South Wales. Where this policy says "we" or "us", that's who it means.
We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth). We do this as a matter of practice, whether or not the Act applies to a business of our size in a given year.
What we collect
Information you give us
This site has no forms on it. You give us information in one of two ways: by booking a call, or by emailing us. Either way we collect:
- Your name
- Your email address
- Your business name, if you give it
- The time you booked, and anything you write in the booking notes
- Anything else you choose to put in a message to us
Bookings are handled by Calendly and Cal.com, so your details go to them first and then to us.
Information collected automatically
When you visit the site, some information is collected without you typing anything:
- Google Analytics. We use Google Analytics 4 to understand which pages get read and where visitors come from. It sets cookies and collects your IP address, browser and device type, the pages you view, how long you stay, and the site or search that sent you here.
- Server logs. Our host, Vercel, keeps standard access logs that include IP addresses and request details.
- Google Fonts. Our typefaces load from Google's servers, which means your IP address is sent to Google when a page loads.
- Cal.com booking widget. Our page for mortgage brokers has a booking calendar embedded in it. That widget loads from Cal.com and can set its own cookies.
We do not use session recording, heatmaps, or advertising pixels on this site.
Why we collect it
- To reply to you, run the call you booked, and follow up about working together
- To run and improve the site, and to see which content is worth writing more of
- To meet our record keeping and tax obligations
If you've given us your email, we may email you about our services. Every marketing email has an unsubscribe link, and you can also just reply and ask us to stop.
Who else sees it
We don't sell your personal information, and we don't trade or rent it. We do use third party services to run the business, and your information passes through them:
- Google (Analytics and Workspace) for site analytics and for our email
- Vercel for website hosting
- Calendly and Cal.com for booking calls
- Cloudinary for hosting images used on the site
These providers store and process data on servers outside Australia, including in the United States. By using this site or submitting a form, you consent to your information being handled overseas by these providers. We choose established providers with their own published privacy terms, but once information sits with them it is also governed by their policies and by the laws of the countries they operate in.
We may also disclose information where the law requires it, or where it's needed to deal with a legal claim.
Cookies, and how to turn them off
Cookies are small files a site stores in your browser. Ours are used for analytics only. Nothing on this site needs a cookie in order to work, so you can block them and still read everything.
To stop Google Analytics tracking you:
- Install Google's opt-out browser add-on, which works across every site that uses Analytics, or
- Block or clear cookies in your browser settings, or browse in a private window
How long we keep it
We keep enquiries and booking records for as long as there's a reasonable chance we'll work together, and then for seven years after any engagement ends, which is the period our tax and record keeping obligations require. Analytics data is retained by Google on a rolling basis under our account settings. If you ask us to delete your details and we have no legal reason to keep them, we will.
Keeping it secure
Enquiries and booking notifications land in a Google account protected by two factor authentication, and access is limited to the people in our business who need it. No system is perfectly secure, and we can't guarantee information sent over the internet is safe in transit. If a breach happens that's likely to cause you serious harm, we'll tell you and notify the Office of the Australian Information Commissioner.
Seeing, fixing or deleting your information
You can ask us what personal information we hold about you, ask us to correct it, or ask us to delete it. Email hello@brightwaters.ai and we'll respond within 30 days. There's no charge. We may need to verify who you are before we hand anything over.
If you're not happy with how we handled it
Email hello@brightwaters.ai first and we'll try to sort it out. If you're still not satisfied, you can take it to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
Children
This site is for business owners. We don't knowingly collect information from anyone under 18. If you think a child has given us their details, email us and we'll delete them.
Client data
This policy covers this website. When we work with you on a project, we're often handling your business data, which is a bigger question. That's covered separately in how we handle your data and in the agreement for your engagement.
Changes to this policy
We'll update this page when what we do changes, and the date at the top will change with it. If a change materially affects how we use information you've already given us, we'll email you.
